You agree not to reproduce, retransmit, broadcast, distribute, disseminate, sell, publish or circulate any such material to any third party without the express prior written consent of urbanest.

Save for the above, urbanest does not grant any licence or right in, or assign all or part of, its intellectual property rights in the content or applications incorporated into the website or in the user interface of the website.

2. You must not attempt to change, deface, remove, add to, hack or otherwise interfere with this website or any material or content displayed on this website.

3. You acknowledge and accept that the information contained on this website (the website information) may include technical inaccuracies. You acknowledge and accept that the website information is subject to change at any time and may not necessarily be up to date or accurate at the time you view it. If urbanest becomes liable for any breach of any such condition or warranty, urbanest’s liability shall be limited at its option, to any one or more of the following:
(a) in the case of goods, to anyone it determines of the following: replacement of the goods or the supply of equivalent goods; repair of the goods; payment of the cost of replacing the goods or acquiring equivalent goods; or payment of the cost of having the goods repaired; and
(b) in the case of services, to either supplying the services again or payment of the cost of having the services supplied again.

6. These Terms and Conditions are governed by and construed in accordance with the State of Queensland, Australia. In the event that a dispute arises from these terms and Conditions, you agree to submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.

urbanest Pty Limited ACN 128 382 310 (urbanest) is committed to protecting the privacy of your personal information.

The urbanest Group (referred to in this policy as we, us, our) provides quality rental accommodation for students. Our accommodation is close to the CBD and major universities, and rent includes utilities, internet and contents insurance. To provide these products and services to you, we need to collect, use and disclose your personal information.

urbanest is required to comply with the Privacy Act 1988 (Cth) including the privacy principles relevant to the private sector (currently the National Privacy Principles and from 12 March 2014 the Australian Privacy Principles (APPs)). Our procedures promote the handling of your personal information in accordance with the APPs, to protect and maintain the privacy, accuracy and security of your personal information.

This policy is intended to provide a general overview of the policies for the handling of your personal information by urbanest and other Australian entities in the urbanest Group.

Collection of your personal information

We only collect and hold personal information that we need to carry out our business functions. This includes to provide you with the student accommodation and other products and services that we offer, and to provide you with marketing and promotional information about the urbanest Group, including special offers, which we consider may be of interest to you.

The types of personal information we collect about you, and our use of that information, is dependent on the products and services we provide to you. Generally, this personal information will include (but is not limited to) your name, address, date of birth, telephone number, nationality/country of origin, emergency contact details. We also may require the name of the institution you are studying at and the duration of the course that you are studying.

Generally, we only collect your personal information from you, except in limited circumstances (e.g., where a person to whom we provide accommodation lists you as an emergency contact person. By providing us with personal information about a third party, you warrant that you have that person’s consent to us collecting and handling their personal information in accordance with this privacy policy. We will always use fair and lawful means of collecting your personal information.

When collecting your personal information, we will inform you generally about the purpose of collection, who we will disclose the information to, any law that requires us to collect the information and the main consequences if you do not provide all of the information requested.

Use and disclosure of your personal information

We may exchange your personal information between the urbanest Group companies.

The urbanest Group of companies will use and disclose your personal information for the purposes for which we collected it, and for other related purposes that you would reasonably expect.

Generally, these purposes include providing you with our products and services, providing you with marketing information or offers regarding other products and services of the urbanest Group, conducting marketing and other promotional activities, and obtaining your feedback on our products and services. By providing us with your personal information, you consent to us using your personal information for these purposes. You agree that we may send you such information by post or by electronic means (including e-mail and SMS). You can opt-out of marketing and promotional communications at any time by contacting our Privacy Officer on (02) 8415 6400, or by using the opt-out mechanism provided in each communication.

We may also disclose your personal information to third parties (including, for example, our agents and contractors who provide services to us) for these purposes. In doing so, we will expect that these third parties are bound by the APPs, or are contractually required by us to uphold the standards of the APPs, to ensure your personal information is protected. Our agents and contractors include those who provide us with services, and those who perform business services or functions on our behalf.

The urbanest Group of companies does not provide your personal information to any third party outside the urbanest Group for the purpose of that third party using your information to market, offer or sell their products or services to you.

Apart from the above instances, we may also use and disclose your personal information with your consent and as otherwise required or permitted by law.

Security of your personal information

We take reasonable steps to securely store your personal information to ensure it is protected from loss, misuse or unauthorised access, disclosure, interference or modification. We safeguard your personal information through written privacy procedures and physical, electronic and other procedural protection. Information is destroyed or permanently de-identified when it is no longer needed for any purpose for which it was collected.

We cannot guarantee the privacy or security of any personal information provided via our website at www.urbanest.com.au, during transmission. Once received, we will then take reasonable steps to securely store that information to ensure it is protected from loss, misuse or unauthorised access, disclosure, interference or modification.

Identifiers

We will use an identifier unique to the urbanest Group to identify the personal information that we hold about you. We do not assign Commonwealth Government identifiers (e.g. Medicare numbers) or State Government identifiers (e.g. driver’s licence numbers) for this purpose.

When purchasing from urbanest your financial details are passed through a secure server using the latest 128-bit SSL (secure sockets layer) encryption technology. 128-bit SSL encryption is approximated to take at least one trillion years to break, and is the industry standard.

Access and accuracy of your personal information

urbanest is committed to ensuring that your personal information is accurate, complete and up-to-date. If you believe any of your personal information in our records is not accurate, please contact the urbanest Privacy Officer via the details shown below.

Upon your request, we will provide you with access to your personal information from our records, except in limited circumstances where the APPs permit us to deny access. Any such requests should be directed to the urbanest Privacy Officer via the details shown below.

Making a complaint

If you believe we have breached our obligations under the Privacy Act (including the National Privacy Principles, or from 12 March 2014, the Australian Privacy Principles), you should contact the urbanest Privacy Officer via the contact details below.  We will provide you with confirmation that we have received your complaint which will set out the time frame we require to investigate your complaint and provide you with a response.  We endeavor to provide you with a response as quickly as possible (which generally, will be within 14 days of receiving your complaint).

The urbanest website may contain links to other websites. urbanest is not responsible for the privacy practices or the use and protection of your personal information on those websites.

Generally, we will not transfer your personal information overseas, except upon your request, or if we are authorised to do so by law.  We may, however, disclose your personal information to other members of the urbanest Group outside of Australia, including (without limitation) in the UK, China and the United Arab Emirates.

Room preferences

While urbanest will attempt to accommodate all room selections and preferences, we cannot guarantee an offer on any room. Rooms may be allocated subject to availability.

Refund Policy

Refund conditions

Refunds will be provided to prospective residents if the following conditions are satisfied:
a. The prospective resident does not wish to exercise the option to enter into a rooming accommodation agreement (“lease option”) with urbanest South Bank Leasing Pty Limited, urbanest North Terrace Leasing Pty Limited, urbanest Berkeley Street Leasing Pty Limited, urbanest Cleveland Street Leasing Pty Limited or urbanest Quay Street Leasing Pty Limited (“urbanest “), and,
b. The prospective resident notifies urbanest of their intention not to exercise the lease option with urbanest and,
c. The notification is received in writing or by email by urbanest prior to the end of the option period, where the option period generally is between the date at which the Advanced Rent Payment is paid and when the Rooming Accommodation Agreement is to commence.

If the above conditions are all satisfied, urbanest will issue a full refund to the prospective tenant within 10 working days after receipt of notification.

No refunds will be provided if prospective tenant does not exercise the lease option but does not notify urbanest of this intention prior to the end of the lease option term.

Special cases

While the above applies to most cases, urbanest is willing to review special cases where refunds might be provided if notification is received after the end of the lease option term. This only applies to cases where there is a family death, severe illness or other such special case. These will be reviewed on a case-by-case basis. urbanest reserves the right to determine the refund amount, whether it will be a full refund, partial refund or no refund.

Other cases

Refunds will not be issued for any other reasons.
